1. Who are we?

Whizzad.net is operated by Abilaja Cyberspace, a company incorporated in India under the Companies Act, 2013. Our registered office is located at Kariyamangalathu Vilai, Kanyakumari-629166. (Hereinafter referred to as “Whizzad.net” or “the Company”).


2. What Data Do We Collect About You?

We collect various types of information to provide and improve our Services. This data falls into two main categories: data you provide directly to us and data we collect automatically.

2.1 Data Provided Through Direct Interactions

A. Registration and Other Account Information: When you register or otherwise interact with our Services, we may collect the following information:

  • Google Account Registration: If you register using your Google account: your first name, last name, and email address.

  • Facebook Account Registration: If you register using your Facebook account: your first name and last name as displayed on your Facebook account, Facebook IDs, and the URL to your Facebook profile picture. Depending on the permissions you grant through Facebook’s in-app privacy option during registration, we may also collect your gender, age, or email ID.

  • Mobile Number Registration: If you register using your mobile number: your mobile number.

  • Apple ID Registration: If you register using your Apple ID: your first name, last name, and email address (you can choose whether to share your email address when signing in with your Apple account).

Depending on your choices during login or engagement with our Services, you may opt to provide the following additional personal data:

  • Your full name.

  • Email address.

  • Mobile number.

  • Details of your vehicle (e.g., make, model, year, trim, mileage) if you are listing a car.

  • Your credit card/debit card details if you choose to purchase our paid services as defined in our Terms of Use (please note we do not store full payment card details; see Section 3.1.4 for more information).

  • Copy of your identity proof (e.g., driving license, passport, or other valid ID) and a real-time image of your face, if you opt for KYC verification (currently available to a limited number of users).

  • A copy of the Registration Certificate (RC) of your vehicle if you choose to provide it while listing your car on our Services (currently available to a limited number of users).

B. Validation of Your Whizzad.net Account: To ensure each account is associated with a real and unique user, we validate Whizzad.net accounts using SMS verification. This process is initiated when you proceed to post your first ad listing. We will send an SMS to the valid mobile number you provide. This service is entirely free of charge. If you do not agree to validate your account via SMS, your account will remain active but with limited functionality. This means you will not be able to publish new ad listings, or edit, update, promote, extend, reactivate, deactivate, or delete existing ad listings until your account is SMS verified. You will also be unable to receive or reply to messages from other users. If you create multiple Whizzad.net accounts using the same mobile number and validate them all via SMS, all such accounts will initially have limited functionality. You will be prompted to choose one primary account to return to full functionality, while the others will remain limited. Each user can request a maximum of 5 SMS verification codes within a 24-hour period. Account validation is a one-time process for each account, until successfully verified. Once validated, your Whizzad.net account will remain associated with the mobile number used for SMS verification. Should you wish to change the mobile number linked to your account, please contact our Customer Support team.

C. Communication Through Our Chat Feature: When you use our integrated chat feature to communicate with other users, we collect the information you choose to provide and share through these communications.

D. Participation in User Surveys: We may occasionally invite you to participate in user surveys to measure your satisfaction with our Services. For this purpose, we will use a session log (a random identifier assigned to you upon downloading our mobile app or visiting our website). You may also choose to provide your contact details (email, mobile number) upon our request to participate in user experience (UX) tests or interviews. Please be aware that survey responses may voluntarily contain personal data you provide in your answers.

2.2 Data We Collect Automatically When You Use Our Services

When you interact with our Services, we automatically collect the following information about you:

  • Device Information: We collect device-specific information such as your operating system version, unique device identifiers (e.g., IMEI number, if collected), and the name of the mobile network you are using. We associate these device identifiers with your Whizzad.net account.

  • Location Information: Depending on your device permissions, if you post an item on our Platform, we automatically collect and process information about your actual location. We use various technologies to determine location, including IP address, GPS, Wi-Fi access points, and mobile towers. Your location data enables you to view user items near you and assists you in posting items within your location. We will always present a pop-up requesting your permission before accessing your location data. If you decline, you may still use our Services but with limited functionality. You can always adjust your location sharing permissions in your device or Platform settings.

  • Client and Log Data: We collect technical details, including the Internet Protocol (IP) address of your device, time zone settings, and operating system. We also store your login information (registration date, date of last password change, date of the last successful login), and your browser type and version.

  • Clickstream Data: We collect information about your activity on our Platform, including the websites from which you accessed our Platform, the date and time of each visit, searches you have performed, listings or advertisement banners you clicked, your interaction with such advertisements or listings, the duration of your visit, and the order in which you visit content on our Platform.

  • Cookies and Similar Technologies: We use cookies to manage user sessions, store your preferred language selection, and deliver relevant advertisements. “Cookies” are small text files transferred from a web server to your device’s hard drive. They may collect information such as the date and time of your visit, your Browse history, preferences, and username. You can configure your browser to refuse all or some cookies, or to alert you when websites set or access cookies. Please be aware that disabling or refusing cookies may lead to certain parts of our Services/Platform becoming inaccessible or not functioning properly.   • Credit Information: We may check/obtain your credit information from third-party sources where permissible by law and relevant to our services (e.g., for certain financial product listings).

  • Call Recording: If our representative calls you on the telephone or if you call us on the telephone to discuss your listed item (e.g., a car), we will record such calls for training, internal quality assurance, and dispute resolution purposes.


3. Why Do We Process Your Personal Information?

We will only use your personal data when the law allows us to. Most commonly, we process your personal data under the following circumstances:

  • Where it is necessary to perform the contract we are about to enter into or have entered into with you (e.g., to facilitate a listing, provide a service).

  • Where it is necessary for our legitimate interests (or those of a third party) to improve our Services, ensure a safe and secure Platform, and enhance business operations, provided your fundamental rights do not override these interests.

  • Where we need to comply with a legal or regulatory obligation (e.g., anti-fraud measures, data retention requirements).

  • Where you have provided your explicit consent for a specific purpose.

Below is a description of the purposes for which we use your personal data, and the legal bases we rely upon for processing.

3.1 For Providing Access and Delivering Services Through Our Platform

  1. Account Access and Identification: If you log in using your mobile number, email ID, Facebook, Google, or Apple ID, we use your first name, last name, and/or email address to identify you as a user and provide secure access to our Platform.

  2. Facilitating Service Delivery: We process your registration data and other account information to manage your account, enable you to post and manage listings, and facilitate communications between users through our chat feature.

  3. Third-Party Payment Processing: We utilize third-party payment service providers to process any payments you make for our Services. Depending on your chosen payment method, you may be requested to provide payment and credit card details, which we then securely transmit to the payment service provider. We do not store your full credit card information. However, if you choose to save such information for recurring payments, we will only store your cardholder name, card expiry date, card type, and the last four digits of the card number. We do not store any credit card code verification values (CVV/CVC) and merely forward such values and your encrypted credit card number for payment processing.

  4. Sharing Data with Select Partners: We may share your data with select partners during the course of our business operations, who are contractually obligated to respect and protect your privacy as we do. These partners may use your information (including your contact information and details of the item to be sold or bought) to deliver services tailored to your preferences and interests. We collaborate only with legally compliant entities that use your data solely to provide relevant offers and services. We recommend you review their respective Privacy Policies for detailed information on their data handling practices. You retain the option to opt out of receiving such tailored services by contacting our Customer Support team or Grievance Officer. By continuing to use our Services, you consent to the sharing of your data with our select partners for personalized communications. We are continuously dedicated to ensuring your personal information is handled responsibly.

We process the above information for the adequate performance of our contract with you.

3.2 For Improving Your Experience and Developing New Functionalities

  1. Enhancing Content and Search Results: We use clickstream data to:

    • Offer you tailored content and provide more relevant search results when you use our Services.

    • Analyze your time spent on our Platform and your navigation patterns to understand your interests and improve our Services (e.g., suggesting content based on your clicks).

    • Monitor and report the effectiveness of campaign delivery to our business partners and for internal business analysis.

  2. Personalizing with Location Data: If you choose to provide your location data, we use it to:

    • Compile anonymous and aggregated information about the characteristics and behavior of Whizzad.net users (for business analysis, segmentation, and anonymous profile development).

    • Enhance the performance of our Services and personalize content (e.g., displaying ad listings in your vicinity to improve your buying experience). For this purpose, Google Maps is integrated into our Platform, meaning both Google and Whizzad.net are involved in processing your location data for Google Maps functionality. Whizzad.net will not process your location data for purposes beyond those explained in this Privacy Policy. Google may process such data for its own purposes as detailed in the Google Privacy Policy. Your use of Google Maps through our Platform is subject to Google Maps’ Terms of Service.

    • Measure and monitor your interaction with third-party advertisement banners placed on our Platform.

  3. Cross-Device Experience: We use your account information (including email ID and phone number) to map the different devices (desktop, mobile, tablets) you use to access our Platform. This allows us to associate your activity across devices, providing a seamless user experience.

  4. Machine Learning for Platform Enhancement: We use images you upload, descriptions, and prices from your ad listings to train machine learning models. This helps us personalize search results, improve ad ranking and user interest matching, enhance the identification and presentation of ad listings, optimize search functions, and increase the likelihood of successful sales. This continuously improves our Services and your user experience.

  5. Automated Recommendations: To show and recommend ad listings that may interest you, we utilize algorithms that analyze your Browse behavior, purchased items, clickstream data, user ID, and location data (if permitted). This form of automated decision-making is based on our legitimate interest in improving our Services by offering more relevant listings.

  6. Chat Content Analysis: We access and analyze your chat messages with other users via our Platform’s chat function for product enhancement and to provide a better user experience (e.g., identifying sold items to show active listings only). We develop and train machine learning models and algorithms to automatically analyze chat content. During this process, we strive to de-identify chat content as much as possible by filtering and hiding personal data (names, phone numbers, email addresses). Highly restricted access rights apply to selected machine learning specialists who may manually review exemplary chat content for training purposes, though personal data you chose to provide might still be visible in such cases.

  7. KYC Verification: If you opt for KYC verification, we will request real-time images of your face and identity proof to verify your identity. Upon successful matching, your account will be verified, helping to build trust with other users and improve responses to your listings.

  8. RC Review for Car Listings: If you provide your car’s Registration Certificate (RC) image during an ad posting, we will review it internally. If RC details match the car’s registration number, your ad listing will state “RC reviewed by Whizzad.net,” helping to build trust and potentially improve responses. No RC details will be displayed publicly on our Services.

We process the above information for the adequate performance of our contract with you and on the basis of our legitimate interest to continually improve your experience of our Services.

3.3 For Platform Security, Fraud Prevention, and Protection

  1. Platform Administration and Security: We use your mobile number, log data, and unique device identifiers to administer and protect our Platform (including troubleshooting, data analysis, testing, fraud prevention, system maintenance, support, reporting, and data hosting).

  2. Chat Content for Safety and Fraud Prevention: We access and analyze your chat messages with other users through our Services’ chat function for customer satisfaction, safety, and fraud prevention purposes (e.g., blocking spam or abusive messages). We develop and train machine learning models and algorithms to automatically detect and prevent inappropriate and fraudulent user behavior. During analysis and training, we de-identify chat content by anonymizing unique identification values. In limited circumstances, customer safety and security specialists may manually review chat content if there are strong indications of fraudulent activities, under highly restrictive access rights.

  3. Automated Fraud Detection: To prevent and detect fraud on our Services, we use algorithms that recognize suspicious or fraudulent user behavior based on information such as user activity and posted content. This may lead to automated banning of certain user accounts when there is a very high degree of certainty that an account or action is fraudulent. Otherwise, human review by selected customer safety and security specialists occurs under highly restrictive access rights. This automated decision-making is based on our legitimate interest to detect and prevent fraud and maintain a safe and secure environment for our users. If you believe your account was wrongfully banned, you can contact our Customer Support team for a review of the decision.

  4. Device-Based Fraud Prevention: We collect certain information from and in relation to the electronic device from which you access our Services (User ID, IP address, device language settings, brand, type, operating system and version, browser type and version, and device-specific software information like fonts, system and browser time zone, available video and audio formats). This is based on our legitimate interest in preventing fraud. This information is used to determine if the same device is being used for various interactions, which is associated with a user fraud score that may lead to account bans. We process the above information based on our legitimate interests in ensuring the security and integrity of our Platform, preventing fraud, and protecting our users.

3.4 For Your Feedback, Promotions, and Offering Relevant Services

  1. Feedback Collection: We may contact you via your registered mobile number or email ID to gather your feedback about our Services.

  2. Personalized Recommendations: We use your email address and mobile number (via SMS) to send you suggestions and recommendations about our Services that may be of interest to you.

  3. Campaign Effectiveness: We use clickstream data to monitor and report the effectiveness of campaign delivery to our business partners and for internal business analysis.

  4. Location-Based Ads: If you choose to provide your location data, we may use it to measure and monitor your interaction with third-party advertisement banners placed on our Services.

We process the above information based on our legitimate interest in undertaking marketing activities to offer you Services that may be of your interest. Specifically, you may receive certain marketing communications from us:

  • By any preferred means of communication if you have requested such information from us.

  • By email or phone, regarding similar products and services, if you already use our Services or have acquired some of our products.

  • By phone or email, if you provided us with your details when you entered a competition or registered for a promotion.

Please note: As a registered user on our Platform, even if you have registered yourself on DND (Do Not Disturb)/DNC (Do Not Call)/NCPR (National Customer Preference Register) services, you may still receive the above communications, as these are related to your ongoing use of our services or based on your direct consent for such communications.

You can ask us to stop sending you such marketing communications at any time by clicking on the opt-out link in the email, changing your notification settings in your account, or informing our calling agent that you do not wish to be contacted for marketing purposes.


4. How Will We Inform You About Changes to Our Privacy Policy?

We may amend and update this Privacy Policy from time to time to reflect changes in our practices or applicable laws. We will notify you of material changes to this Privacy Policy as appropriate under the circumstances and as required by applicable laws (e.g., by placing a prominent notice within our Services, sending you a message via our Services, or sending you an email). If you do not agree with the way we are processing your personal data or the choices we are providing to you, you may close your account at any time by navigating to your account settings and selecting “Deactivate account and delete my data.”

We will communicate with you by email, SMS, or in-app notifications in connection with our Services/Platform to confirm your registration, to inform you when your ad listing goes live or expires, and for other essential transactional messages related to our Services. As these transactional messages are imperative for providing our Services, you may not be able to opt out of receiving them.


6. Who Do We Share Your Data With?

We may have to share your personal data with the parties set out below for the purposes outlined in Section 3 above:

  • Corporate Affiliates: We may share your data with our group companies and corporate affiliates who assist us in providing essential business operation services such as product enhancements, customer support, and fraud detection mechanisms.

  • Select Partners: We may share your personal information, which includes your name, phone number, and email address, with select partners during the course of our business. These partners are contractually bound to respect and protect your privacy in the same manner we do and may utilize your information to deliver services tailored to your preferences and interests. You may contact our Grievance Officer if you do not wish to receive such services.

  • Third-Party Service Providers: We use third-party service providers to help us deliver certain aspects of our Services, such as cloud storage facilities, analytics, and payment processing. We conduct due diligence on our third-party service providers and require them to respect the security of your personal data and to treat it in accordance with applicable law and our instructions.
